Release and Waiver of Claims and Liability

By signing this release and waiver of claims and liability, the student, parent or guardian acknowledges that they have read this agreement and will abide by all rules of Americana BJJ, LLC. Signing this waiver also means that the undersigned/student releases Americana BJJ, LLC, its instructors and other members from any liability in case of injury or death from the instruction and participation at Americana Jiu Jitsu.

Regarding Brazilian Jiu Jitsu classes: In consideration of being allowed to attend a Brazilian Jiu Jitsu class, the undersigned/student acknowledges that Brazilian Jiu Jitsu is a physical activity and that participation may result in serious injury, including death, and or other damage, due not only to the undersigned/students actions, inaction or negligence, but also to that of others associated with and or present at these or other classes. Furthermore, I acknowledge that there may be risks not known to me and or not reasonably foreseeable at this time. I personally, totally, and completely assume all risks involved or in any way related to my participation in Brazilian Jiu Jitsu class whether known or unknown to me at the present time. Participation in Brazilian Jiu Jitsu class is voluntary and entirely of my own free will. 

The undersigned/student, heirs, executors, and successors hereby waive claim of accidental and or negligent damages or injury against Americana BJJ, LLC, its principals, owners, instructors, affiliates, and any physical or virtual location where an Americana Jiu Jitsu class or seminar is taught.

I understand that photographs or videos may be taken during participation in any activity at Americana Jiu Jitsu. I hereby grant Americana BJJ, LLC permission to use any such photograph, video, or other digital media of undersigned/student’s in any and all of its print or web-based publications, including social media, without payment or other consideration.

TERMS AND CONDITIONS:

These terms and conditions are entered into by and between Americana Jiu Jitsu and You (“the Member”).

Services:

The membership entitles the participation of the selected program's classes at Americana Jiu Jitsu.

Membership is nontransferable.

Code of Conduct:

The Member shall respect the instructors and fellow members.

The Member agrees to abide by all policies, guidelines, rules, and regulations, including any verbal or written instructions provided by the instructor, and not endanger any other member.

Suspension/Termination of Membership:

If the Member behaves in a way that breaches the code of conduct, interferes, or disturbs other members or staff, or that the management considers inappropriate, the membership can be suspended or terminated at management’s sole discretion.

If the Member does not pay the membership fees after a reminder, the membership can be suspended or terminated at the management’s sole discretion.

Payment:

The Member is responsible for the payment of the membership.

Subscription membership (paid monthly): the 1st month’s payment is paid at the point of this agreement. If the payment is not made, the member will receive notice from Americana Jiu Jitsu reminding him/her that the payment needs to be completed within 5 working days, or the member will be suspended until the payment is completed. Americana Jiu Jitsu has the right to charge the members for expenses linked to delayed payment. If a member is suspended, the membership is not frozen, but continues to run.

I authorize Americana Jiu Jitsu to initiate a recurring charge to the credit card or bank account indicated for the total amount due each month. I understand I may cancel this recurring charge upon written notice according to the terms of this contract.

Renewal & Cancellation:

Subscription membership (paid monthly): The contract is ongoing and automatically renews. If the Member wishes to cancel the membership, he/she should send a cancellation email to info@americanajj.com 30 days prior to the next billing cycle.

Month-to-month membership (1 month): Unless the Member has not requested the membership be automatically renewed, the membership will be renewed for 1 month at the end of the contract period. If the Member wishes to cancel the membership, he/she should send a cancellation email to info@americanajj.com 30 days prior to the next billing cycle.

Membership can be cancelled upon the death or disability of the Member, or if the Member moves more than 25 miles from Americana Jiu Jitsu. This information is to be provided via email to info@americanajj.com or in person at Americana Jiu Jitsu.

Frozen Membership:

Membership may be frozen at any time due to sickness or injury giving 10 days’ notice and may be subject to the payment of $45 monthly Freeze Fee. A medical note is required. The membership can be frozen for 1-6 months, and is automatically activated once the period ends. The membership cannot be frozen in retrospect.

Brazilian Jiu Jitsu Belt Testing, Other Fees, & Hidden Costs:

Our membership cost is all inclusive. Occasional fees for optional one-time events such as seminars or in-house tournaments will be minimal. We sell Jiu Jitsu gis and gear at affordable prices due to our relationship with gi manufacturers and distributors, but members are not required to purchase gis from us.

There are no belt testing fees or belt testing in general. Members are promoted when the instructor sees they are ready for promotion — never on a scheduled attendance card with increased fees as they are promoted. Members are responsible for purchasing their own belts.
